Who has dealt with the developer Emerald Yapı in Mersin?
Hello! We. We passed the house 1.5 years late, we didn't finish it completely. The additional agreement was not fulfilled. The developer's response to our objections was "you'll get used to it, it's the same everywhere here."
Currently, there is a 5-month delay. They guarantee a minimum of a year of delay. I am currently studying the issue of legal action against the developer. In Turkey, there is no fixed percentage of liability. We do not incur any losses. At the moment, I think they will charge us a small penalty. If anyone has experience with legal claims against developers regarding delays.
@Zaur: What does compensation mean? Money for the purchase + compensation?
@Nikolay: Compensation for missed deadlines
We built in the Lavigna Astoria complex in Sol, the complex was delivered with a 9-month delay. Next to us is the Emerald complex, which is highly ready, or rather externally everything is ready. I was surprised when I was there in September that there were no residents, there is no light in the windows anywhere, it's strange, although the house externally and in terms of infrastructure is even better done than ours.
Good day! There was a consultation with a lawyer. In Turkey, the deadline is +180 days, which means no compensation will be given. Beyond this period, you can consult a lawyer. As he said, the compensation depends on the price of the property.
Similarly, the developer is different, but the song about delays is the same, the house is built, get ready for the HOA to assert their rights, you are sort of the owner and sort of not 🤷🏻♀️
@Olga: Apparently, it's really the same everywhere. We need to get used to it)
